The legal basis

Gambling winnings are not subject to Income Tax or Capital Gains Tax in the UK. The statutory basis for this is Section 568 of the Income Tax (Trading and Other Income) Act 2005 โ€” gambling does not constitute a trade for tax purposes in the majority of cases.
